Thanks to the specially prepared IT service of the Court, proceedings are conducted exclusively online, allowing the arbitrator to handle the case 24 hours a day, 7 days a week, from anywhere in the world. Thus, it is unnecessary to travel to the court building or arrange hearings. There is no need to summon witnesses or wait for postal returns. As a result, they can work swiftly, easily, and without conflict with other professional duties.

  • IT technology supports arbitrators' work

The Court's IT system eliminates unnecessary actions of the arbitrator. To issue a decision, the arbitrator selects the type from a list and, if needed, provides its reasoning. That's it! The system automatically prepares a ready draft decision and presents it to the arbitrator for approval. As a result, many types of resolutions can be issued in a matter of seconds, minimizing errors, and ensuring the decision always contains the most current information.

  • the Court's online service promotes procedural efficiency

The Court's online service significantly facilitates the work of both parties and their representatives. Thanks to an agreement with the Ministry of Digital Affairs, Ultima Ratio is connected to the National Node, with identity verification conducted via Profile Zaufany, qualified electronic signature, or e-ID.

Preparing a lawsuit in a special wizard takes only a few minutes. After paying the lawsuit fee through the electronic payment system, the lawsuit is automatically delivered to the defendant, the system randomly selects an arbitrator, and a case profile is prepared.

During the case, it's equally simple. You just need to enter the main message of a procedural letter in the appropriate field, and the system takes care of the rest. It automatically prepares the letter draft, presents it to the author for approval, and informs other participants of its submission. Therefore, there's no need to print or mail anything.

The mobile application and case chat support communication with the opponent and arbitrator.

Conducting procedural actions in Ultima Ratio is thus extremely straightforward and convenient. The arbitrator may therefore require relatively quick responses from the parties and their representatives—requests for additional documents or explanations should, in principle, be answered within 3 days.

  • The regulations prevent deliberate case delays

In Ultima Ratio, the defendant pays an arbitration fee to respond to the lawsuit. The idea is to encourage defence only when they genuinely believe in the strength of their arguments.

Moreover, we have adopted the principle that the company should ensure receipt of a lawsuit or other important letter. Therefore, lawsuits are, in principle, delivered by email, while registered mail is also used, but only for security. In the latter case, deliveries sent to the defendant's address indicated in KRS or CEiDG—with a margin of three days for post circulation—are considered delivered.

In Ultima Ratio, cases cannot be delayed by submitting evidence merely for the sake of delay. Nor can one pretend not to reside or operate somewhere to prevent the delivery of a lawsuit.

All evidence is immediately visible in the case profile, and the system informs the arbitrator via SMS or email about new requests or parties' positions. If necessary, the arbitrator conducts witness hearings through teleconference, which is recorded and can be listened to immediately.

  • videos, photos, screenshots, and audio files quickly clarify cases

In Ultima Ratio, evidence consists solely of electronic materials. Consequently, witnesses or parties are not heard on facts claiming 'white is black and black is white'. The arbitrator sees the matters as they truly are through videos, photos, audio recordings, scans, screenshots, etc. Disputes from online transactions should be resolved online, not in the courtroom. After all, all evidence necessary to adjudicate the case is present online. This makes the arbitrator's work much easier and quicker. 

  • case chat simplifies and speeds up communication

The arbitrator communicates with the parties in a given case via a convenient chat. There's no need to write orders, issue evidentiary rulings, or send anything by mail. If they want to request clarification of certain issues or send missing documents, they simply write a message on the chat. All such correspondence is transparent and immediately visible to both parties.

  • expert opinions within 10 days

Thanks to an agreement with the Polish Association of Court Experts and Appraisers in Warsaw, expert opinions in the 5 most popular specialties (accounting, graphology, IT, automotive technology, and valuation of movable and immovable property) are delivered within 10 days of the order date. The Association advises the arbitrator on which expert is best prepared to give an opinion on the given issue. This allows the arbitrator to precisely plan and control the entire proceedings.

  • potential to handle a large number of cases

The arbitrator works at convenient times, and the online system significantly reduces the time required to resolve a case. This leads to significant interest from the notarial community in serving as arbitrators in Ultima Ratio. There is thus no risk that the Court's efficiency will decline as the number of cases increases. There are about 3,500 notaries in our country compared to about 10,500 judges in ordinary courts.

  • the judiciary of the future

Ultima Ratio is a team of experienced, creative, and ambitious lawyers, IT specialists, and managers. We continually work on streamlining the Court's operations. In the future, the Court's IT system will automatically prepare a draft reasoning for the arbitrator in formal issues. Artificial intelligence will also analyze the case's evidence and precisely indicate relevant Supreme Court opinions. We will also improve statistics. The arbitrator in a given case will have information on the course and outcome of other, similar cases. They will be able to refer to arguments used by other arbitrators to justify their views on particular issues or problems.

In Ultima Ratio, there is thus no reason for cases to last longer than 3 weeks. And sceptics? They will see.
