§.1.
The Platform shall charge the parties to arbitration proceedings the following fees:
an arbitration fee,
other fees in accordance with this Schedule of Fees.
§.2.
The arbitration fee for the statement of claim and the response to the statement of claim shall depend on the value of the dispute and shall amount to:
up to EUR 1,500 – EUR 150
from EUR 1,501 to EUR 1,700 – EUR 170
from EUR 1,701 to EUR 2,000 – EUR 180
from EUR 2,001 to EUR 3,500 – EUR 190
from EUR 3,501 to EUR 5,000 – EUR 200
above EUR 5,000 – EUR 200 plus 5% of the amount exceeding EUR 5,000, but not more than EUR 100,000
The value of the dispute shall be expressed in EURO. Where the amounts claimed are expressed in another currency, such amounts shall be converted into EURO at the official average exchange rate applicable on the date of activation of the statement of claim or response form, or on the preceding day.
Where the claimant regularly uses the tools and services available on the Ultima RATIO Platform aimed at preventing disputes and facilitating their resolution, the percentage rate of the fee for the statement of claim and the response referred to in point (f) of paragraph 1 above shall be reduced to:
4.5% – where the claimant uses the Team Ultima RATIO plan;
4% – where the claimant uses the Business+ Ultima RATIO plan or a special offer for law firms;
3.5% – where the claimant uses the Executive Ultima RATIO plan.
VAT shall be added to the above amounts.
Where a party has understated the value of the dispute, the Arbitral Tribunal may adjust such value.
Where it is impossible to determine the objective value of the dispute, the fee shall be charged according to the lowest rate. However, the Arbitral Tribunal may adopt a higher value of the dispute, taking into account the nature and circumstances of the case as well as the workload involved.
In the event of reconsideration of the case following the setting aside of an arbitral award by a state court in the same matter, 60% of the arbitration fee shall be charged.
§.3.
The Platform shall refund half of the arbitration fee in the event of:
a finding of lack of jurisdiction of the Arbitral Tribunal;
return of the statement of claim or the response to the statement of claim.
§.4.
The Arbitral Tribunal shall collect advances for expenses related to correspondence costs, expert fees, and other similar expenses in the amount determined by the arbitrator. The advance shall be paid by the party requesting the action requiring the expense, under pain of refusal to perform such action.
§.5.
The minimum fees for professional legal representation (advocates and legal advisers) shall amount, depending on the value of the dispute, to:
up to EUR 1,500 – EUR 250
from EUR 1,501 to EUR 1,700 – EUR 350
from EUR 1,701 to EUR 2,000 – EUR 500
from EUR 2,001 to EUR 3,500 – EUR 800
from EUR 3,501 to EUR 5,000 – EUR 1,000
above EUR 5,000 – EUR 1,000 plus 5% of the amount exceeding EUR 5,000, but not more than EUR 100,000
The Arbitral Tribunal may award reimbursement of legal representation costs in a higher amount if justified by the complexity of the case.
