An arbitration clause can take any form. It can even arise from emails exchanged between the parties.
For clients who do not sign contracts with their contractors, we recommend including an arbitration clause in general terms of orders, sales regulations, and other such documents. For the arbitration clause contained therein to become binding, the contractor should accept the terms during the transaction process.
Arbitration clauses are also often found in order forms. If you prepare such a form for clients, ensure it is signed by individuals authorised to represent the client.
